Use of Our Services

Advert provides AI-powered customer communication and workflow automation software to help businesses manage lead follow-up, client engagement, and ongoing communication. Our Services do not guarantee sales, revenue, or customer acquisition. By using our Services, you agree to use them only for lawful purposes and in compliance with these Terms.

Account Registration and Security

  • You may need to create an account to access certain features. You must provide accurate, current, and complete information.

  • You are solely responsible for maintaining the confidentiality of your account credentials and all activity under your account.

  • You must notify us immediately of unauthorized use of your account. Advert is not responsible for losses due to compromised credentials.

Billing and Payments

  • Payment Processing: All payments are securely processed through Stripe.com. We do not store payment card information.

  • Recurring Billing: By subscribing to a plan, you authorize recurring charges according to your selected plan until cancellation.

  • Non-Payment: Failure to process payment may result in suspension or termination of your account.

  • Refund Policy: All refunds, if applicable, are governed by our Refund Policy.

Subscriptions, Cancellation, and Termination

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing cycle.

We reserve the right to suspend or terminate accounts at our discretion, including for non-payment or violations of these Terms.

Upon termination, your right to use the Services will immediately cease.

Prohibited Activities

You agree not to:

  • Use the Services for unlawful, fraudulent, or abusive purposes.

  • Misuse AI bots in ways that harass, spam, or violate consumer protection laws.

  • Copy, modify, reverse-engineer, or distribute Advert’s software without permission.

  • Interfere with the security, stability, or functionality of the Services.

Intellectual Property

All software, AI models, workflows, content, branding, and related materials are the property of Advert. Except as expressly permitted, you may not copy, distribute, or create derivative works without our prior written consent.

Privacy and Data Protection

Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to our collection, storage, and use of personal information as described therein.

Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis. We make no guarantees that use of the AI follow-up software will generate sales, leads, or revenue. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law:

Advert is not liable for any indirect, incidental, consequential, or punitive damages arising from the use or inability to use the Services.

Our total liability is limited to the amount you paid for our Services in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Advert, its affiliates, employees, and partners from any claims, damages, or expenses arising out of:

  • Your use of the Services.

  • Your violation of these Terms.

  • Misuse of AI bots in violation of applicable laws.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Minnesota, United States. Any disputes will be handled exclusively in the state or federal courts of Minnesota, and you consent to such jurisdiction.

Dispute Resolution

Before filing a formal claim, you agree to attempt to resolve disputes informally by contacting us at the email below. If unresolved, disputes may be subject to binding arbitration unless prohibited by law.

We may update these Terms from time to time. Updates will be posted on this page, with the “Last Updated” date revised accordingly. Continued use of the Services constitutes acceptance of the updated Terms.
